TERMS AND CONDITIONS
Booking and Payment
All bookings are subject to these terms and conditions; and these terms and conditions shall constitute the entire agreement between you (‘the Customer’ also referred to as a ‘Participant’) or the person making the booking on your behalf, and Whitewater Ways. Payment of deposit or balance for an activity indicates acceptance of these terms.
Bookings can only be confirmed upon receipt of a deposit or full payment, by bank transfer to Whitewater Ways (details upon request).
Cancellations/transfers by Whitewater Ways
Every attempt will be made to ensure courses run as scheduled. However, we reserve the right to:
Cancel a course should the numbers fail to reach a viable minimum, or that required by BC for a course to run;
Cancel or curtail any course due to unsuitable water conditions, forecast or prevailing weather conditions, or due to any other factors beyond our control.
We will endeavour to offer suitable alternative course dates, but if unable to do so or the alternative course offered is unacceptable to the customer a full refund will be made for all cancelled sessions, calculated pro rata where applicable.
Whitewater Ways shall have no liability arising from cancellation other than as set out above, and we recommend that you book refundable accommodation/transport options.
Cancellations/transfers by the Customer
If you need to cancel or transfer please contact us immediately, so that we can do our best to help you.
Should you cancel; the following scale of charges will apply:
Cancellation more than 30 days before the course starts – full amount refunded, less a £10 admin fee. Or free transfer to another course.
Cancellation between 15 and 29 days before course starts – 50% refunded, or free transfer.
Cancellation 14 days or less before the course starts – 100% of course fee is chargeable. We will, however, endeavour to fill your place, and if successful you will be able to transfer to another course at no cost.
If you wish to transfer from one course to another, or to move your booking to a different date, we will do our best to accommodate this, subject to existing bookings.
Physical Fitness and Medical Conditions
Some of our courses, and the environments in which they take place, can be physically demanding. In submitting a booking you are representing that you, or the person on whose behalf you are submitting the booking, have an adequate level of fitness and preparedness for the activities to be undertaken.
If you have a medical condition, illness or any condition which may affect your ability to take part, you must disclose this on your consent form, and, if appropriate, seek the advice of your doctor before submitting your booking. You must also indicate upon booking if you have any disability or special requirements of which we may reasonably need to be aware.
Safety, Injury and loss of property
Participation in adventurous activities entails some risk of injury. All staff employed by Whitewater Ways are trained and appropriately qualified and insured to run activity sessions and will at all times proceed in a manner to limit the risk of injury. However, customers need to accept that accidents and injuries can happen.
Any participant under the age of 18 years must have the permission of their parent/guardian with legal responsibility before being able to take part in any activity/course offered by the company. The parent/guardian with legal responsibility needs to be aware and accept the risks involved in adventure activities and satisfy themselves accordingly.
Outdoor adventurous activities take place in varied natural environments where there are natural hazards and risks to manage. Every effort will be made by Whitewater Ways staff to provide realistic training in a safe manner. Customers participating in courses are expected to comply with all safety guidance and instructions given by the Company and its staff.
The Company shall not be liable for any illness, injury or loss of life sustained on any course, except where such illness, injury or loss of life is caused by the negligence of the Company or its employees, nor will the Company be liable for any uninsured loss of personal property. For all courses, you are advised to have insurance that covers you for all of the activities.
The customer is responsible for the safekeeping of any company equipment issued for use during the activity/course. With the exception of fair wear and tear the company reserves the right to charge for equipment that has been lost or misused.
Errors and Omissions
Whilst every effort is made to ensure the accuracy of the our publicity information, Whitewater Ways does not accept liability for any errors, inaccuracies or omissions therein, and reserves the right to alter course details at any time. Please check all details and prices before making your booking.
Data Protection/Privacy
The information you have supplied will be treated and stored in accordance with the provisions of the General Data Protection Regulations 2018.
We may take photographs and/or video of participants for publicity purposes, including reproduction on our website and social media, and in submitting your booking you are indicating your consent to the same, unless you indicate otherwise on the booking form.
